Islamic Inheritance Shares: Husband, Mother and 2 Full Sisters ('Awl Case)

A childless woman dies leaving her husband, her mother and two full sisters, with no father to block the sisters. The fixed shares - husband 1/2, mother 1/6, sisters 2/3 - add up to 8/6, more than the whole estate. The 'awl rule scales every share down in proportion so the estate is divided into eight parts instead of six.

What does each heir receive when a woman dies leaving husband, mother and 2 full sisters?

Husband, Mother and 2 Full Sisters: Husband 3/8, Mother 1/8, Full Sisters (2) 1/2 (after 'awl). On a $600,000 estate that is $225,000 to husband, $75,000 to mother, $300,000 to full sisters (2).

Each heir's share on a $600,000 estate

Example estate after funeral costs, debts and any bequest. The fractions are fixed; the dollar amounts scale with the estate, so a $300,000 estate gives each heir exactly half of the figure shown.

HeirShare of estatePercentAmountBasis
Husband3/837.5%$225,000Quran 4:12 - 1/2 (no children)
Mother1/812.5%$75,000Quran 4:11 - 1/6 (with multiple siblings)
Full Sisters (2)1/250%$300,000$150,000 eachQuran 4:176 - 2/3 (multiple full sisters)
  • 'Awl applied: prescribed shares exceed the estate. All shares reduced proportionally.

Why each heir gets that share

Husband

1/2 because there are no children (Quran 4:12). After 'awl: 3/8.

Mother

Capped at 1/6 because the deceased left two or more siblings (Quran 4:11). After 'awl: 1/8.

Full sisters

Two or more full sisters with no child, father or brother take 2/3 between them (Quran 4:176). After 'awl: 4/8, i.e. 2/8 each.

Where scholars differ: 'Awl was adopted by the companions in Umar's time and is applied by all four Sunni schools. Ibn Abbas rejected it, holding that the shortfall should fall on the sisters alone; that view is not followed in practice.

Notes

  • • 'Awl applied: prescribed shares exceed the estate. All shares reduced proportionally.

'Awl Applied

The total prescribed shares exceeded 100% of the estate. All shares have been proportionally reduced. This is an established ruling (Ijma') applied when fixed shares sum to more than the whole.

These shares aren't legally binding yet

Without a state-valid Islamic will, U.S. intestacy law ignores Faraid and a court decides who inherits. Lock in this distribution with a scholar-approved, state-specific Islamic will.

Make these shares legally enforceable

State intestacy law will not apply these fractions on its own. A state-valid Islamic will, or an Islamic living trust if you want to avoid probate, is what turns this table into a binding plan.

The Final Step: Your Scholar Conversation

Major Islamic inheritance (Faraid) decisions involve nuances that vary by scholarly opinion and personal circumstance - which is why HalalWallet is built as the research step, not the ruling. We do the homework on comparisons, structures, and oversight; a qualified Islamic scholar, your local imam, or a Shariah-certified financial advisor covers what no comparison site can - guidance specific to your situation. Bring your shortlist to that conversation so it starts at the decision, not the basics.

How to use this comparison: Scholars rule; we organize the evidence. HalalWallet is an independent educational comparison platform - by design, we do not issue fatwas or provide financial, legal, or tax advice. We do the research homework so your final checks are quick and personal. Where our role ends and who takes over.

Product structures and Shariah oversight vary by provider, so finish with three built-in steps:

  • Confirm current terms and halal compliance directly with the provider - their quote is final.
  • Review the contract structure (Murabaha, Ijara, Musharakah, etc.) and any disclosed Shariah board opinions.
  • Bring your shortlist to a qualified Islamic finance advisor or scholar, so the conversation is about your situation, not the basics.
