Nikah
نكاح
Pronunciation: nih-KAH
The Islamic marriage contract — verbal or written, requiring offer, acceptance, and witnesses.
Definition
The Islamic marriage contract. Validity requires offer (ijab) and acceptance (qabul) between the bride (or her wali) and the groom, witnessed by at least two Muslim witnesses, and inclusion of a mahr. The nikah may be verbal or written, but written documentation is considered best practice.
In the United States, the nikah establishes the religious marriage but is generally not sufficient on its own to function as a legally enforceable U.S. premarital agreement — that role is typically played by a separate Islamic prenup drafted to satisfy state contract law.
