Ijtihad
اجتهاد
Pronunciation: ij-tee-HAHD
Independent legal reasoning by a qualified scholar to derive a ruling where the texts are silent or unclear.
Definition
The disciplined effort of a qualified jurist to derive a legal ruling from the sources for a question not settled by explicit text or consensus. Modern finance is largely a field of ijtihad, because stock markets, fiat money, insurance, pensions, and cryptocurrencies did not exist in the classical period.
Ijtihad is exercised individually by scholars issuing fatwas and collectively by bodies such as the OIC International Islamic Fiqh Academy, AAOIFI's Shariah Board, and national fatwa councils, whose collective rulings carry more weight than any single opinion.
How Ijtihad Works in Practice
The products on this site exist because of ijtihad, and so does the disagreement about them. When a Shariah board approves a diminishing Musharakah mortgage, it is exercising ijtihad: combining classical partnership and lease rules, judging that benchmarking rent to a market index does not corrupt the contract, and deciding how much of the owner's risk the financier must bear. Another board may weigh those elements differently. The quality of ijtihad is assessable even by non-scholars through a few markers.
Qualification: the scholar should have formal training in fiqh and usul al-fiqh (legal theory) and experience in muamalat (transactions), not only general religious credentials. Method: the ruling should cite the texts and classical cases relied on and explain the analogy or principle applied. Independence: a scholar paid by the institution whose product is under review has a conflict that the industry manages through disclosure, rotation, and external audit; ask how a given board manages it. Collectivity: rulings of fiqh academies and standard-setting bodies (OIC Fiqh Academy resolutions, AAOIFI standards) represent collective ijtihad and are generally more reliable than a single scholar's view.
Reversibility: good ijtihad is revised when facts change, as with the movement away from Bai' al-Inah and toward stricter Tawarruq rules. For a consumer, following qualified ijtihad consistently is itself a religiously sound position; shopping across scholars for the most convenient answer to each question is not.
