# Is Owning a Gas Station or Convenience Store Halal?

Owning a gas station or convenience store is halal in itself - fuel, groceries, food, car wash and services are ordinary lawful trade. It becomes haram in the specific lines most American stations carry: beer and wine, lottery and scratch-offs, pork, and (per most contemporary fatwa bodies) tobacco. Selling alcohol is cursed in the hadith, selling lottery tickets is facilitating gambling (maysir), and the income from both is haram and must be given to charity without reward. ## How we read the evidence

Fuel and convenience retail is among the most common Muslim-owned businesses in the United States, and the alcohol-and-lottery question is the single most frequent fiqh question those owners ask. The law is not in doubt: the Quran names khamr and maysir together as 'defilement from the work of Satan' (5:90), the Prophet cursed the seller and the one who buys khamr for another (Abu Dawud 3674), and the hadith of Jabir prohibits the sale of wine, carrion, pigs and idols (Bukhari 2236). What is often misunderstood is purification: scholars treat donating haram income as the remedy for money already earned, not as a fee that permits the sale going forward. The commercial argument - lottery commissions of roughly 5-7% of ticket sales, beer as a traffic driver - is real, which is why the scholars' answer is a business model rather than a prohibition: the dry store. Thousands of Muslim-owned stations operate without alcohol or lottery, growing fuel volume, grocery, prepared halal food, coffee, car wash and services instead. Scholars differ on how long a mixed store may be operated during the transition; none permit keeping the lines indefinitely because they are profitable.

## Scholars' and screeners' positions

- **Mainstream position (four Sunni schools; AMJA fatwas on convenience-store owners)**: Selling alcohol, lottery tickets and pork is haram regardless of the share of revenue; the income is haram and must be purified; the owner is obliged to remove the lines. Owning and operating the station for its lawful trade is permissible.
- **Stricter view**: An owner may not continue operating a store that sells alcohol even temporarily; the lines must be removed before or at acquisition, or the business divested.
- **Mixed-business accommodation (some contemporary scholars)**: Where haram lines are a small minority of sales and the owner is actively working to remove them (for example, waiting out a license period or lease covenant), continued operation during the transition is tolerated with purification of the haram income.
- **Tobacco**: AMJA and most contemporary councils rule the sale impermissible on harm grounds; classical-era opinions classed it as makruh. The cautious path is to drop it with the alcohol and lottery.

## Purification

Income already earned from alcohol, lottery, tobacco or pork sales is haram and must be given to charity without expectation of reward - typically the gross margin on those categories, not the whole store's profit. Interest received on operating balances is purified the same way. Purification is a remedy for past income; it does not license continuing the sales.
